Lee County: Highway 76

State took 14.915 acres out of a 58.372 acre parcel for construction of Highway 76.  An additional 10.685 acres was left without access from a public road after the taking.  The property owner had platted a portion of the property for residential subdivision development at the time of taking.  The taking prevented further development of the owner's plan to develop the property.  In addition, the value of the remaining property was damaged as a result of loss of access and proximity to the new divided limited access highway.  The case was tried in Tupelo, Mississippi, and a Lee County Jury returned a verdict awarding the property owner significantly more compensation that was offered by the State
